1-8 A BILL TO BE ENTITLED
1-9 AN ACT
1-10 relating to the disapproval of a subdivision by a municipality.
1-11 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-12 SECTION 1. Subsection (a), Section 212.009, Local Government
1-13 Code, is amended to read as follows:
1-14 (a) The municipal authority responsible for approving plats
1-15 shall act on a plat within 60 <30> days after the date the plat is
1-16 filed. A plat is considered approved by the municipal authority
1-17 unless it is disapproved within that period under the provisions of
1-18 Section 212.005 and a complete list of unmet regulations is
1-19 provided to the applicant as soon as practicable.
1-20 SECTION 2. The change in law made by this Act applies only
1-21 to a plat for a subdivision filed with a municipality on or after
1-22 the effective date of this Act. A plat filed with a municipality
1-23 before the effective date of this Act is governed by the law in
1-24 effect when the plat was filed, and the former law is continued in
1-25 effect for that purpose.
1-26 SECTION 3. This Act takes effect September 1, 1995.
1-27 SECTION 4. The importance of this legislation and the
1-28 crowded condition of the calendars in both houses create an
1-29 emergency and an imperative public necessity that the
1-30 constitutional rule requiring bills to be read on three several
1-31 days in each house be suspended, and this rule is hereby suspended.
