                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to the authority of a governmental entity to regulate the
    1-2  location of a private club.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Subsection (d), Section 109.57, Alcoholic
    1-5  Beverage Code, is amended to read as follows:
    1-6        (d)  This section does not effect the authority of a
    1-7  governmental entity to regulate, in a manner as otherwise permitted
    1-8  by law, the location of:
    1-9              (1)  a massage parlor, nude modeling studio, or other
   1-10  sexually oriented business; or
   1-11              (2)  an establishment that derives 75 percent or more
   1-12  of the establishment's gross revenue from the on-premise sale or
   1-13  service of alcoholic beverages.
   1-14        SECTION 2.  The importance of this legislation and the
   1-15  crowded condition of the calendars in both houses create an
   1-16  emergency and an imperative public necessity that the
   1-17  constitutional rule requiring bills to be read on three several
   1-18  days in each house be suspended, and this rule is hereby suspended.
