By: Gallegos S.B. No. 1014 A BILL TO BE ENTITLED AN ACT 1-1 relating to promotional systems in certain police departments. 1-2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-3 SECTION 1. Subsection (b), Section 143.035, Local Government 1-4 Code, is amended to read as follows: 1-5 (b) On the recommendation of the head of the police 1-6 department, or on receipt of a petition signed by at least 20 1-7 percent of the sworn police officers in the department, which may 1-8 be vetoed by the head of the police department, and after a simple 1-9 majority vote of the sworn police officers in the department who 1-10 vote in the election at which the issue is submitted to a vote, the 1-11 commission may adopt an alternate promotional system to select 1-12 persons to occupy nonentry level positions other than positions 1-13 that are filled by appointment by the department head. The 1-14 promotional system must be a system suggested by the head of the 1-15 police department or the petitioning police officers, as 1-16 applicable, and must comply with the requirements prescribed by 1-17 this section. 1-18 SECTION 2. The importance of this legislation and the 1-19 crowded condition of the calendars in both houses create an 1-20 emergency and an imperative public necessity that the 1-21 constitutional rule requiring bills to be read on three several 1-22 days in each house be suspended, and this rule is hereby suspended, 1-23 and that this Act take effect and be in force from and after its 1-24 passage, and it is so enacted.
