No. 1019 A BILL TO BE ENTITLED AN ACT 1-1 relating to social security coverage of certain student employees 1-2 of public institutions of higher education. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Subsection (a), Section 606.064, Government Code, 1-5 is amended to read as follows: 1-6 (a) The state shall pay all contributions on wages for 1-7 social security coverage of a state employee except: 1-8 (1) as provided by Section 606.065 or 606.073; or 1-9 (2) the amount of the employee tax in excess of 5.85 1-10 percent of wages computed on a wage base of $16,500 in a calendar 1-11 year. 1-12 SECTION 2. Subchapter C, Chapter 606, Government Code, is 1-13 amended by adding Section 606.073 to read as follows: 1-14 Sec. 606.073. STUDENT EMPLOYEES OF INSTITUTIONS OF HIGHER 1-15 EDUCATION. (a) A student employee of an institution of higher 1-16 education is exempt from social security coverage. 1-17 (b) In this section: 1-18 (1) "Institution of higher education" has the meaning 1-19 assigned by Section 61.003, Education Code. 1-20 (2) "Student employee" means a student enrolled and 1-21 regularly attending classes in an institution of higher education 1-22 and who is employed by the institution for not more than 30 hours a 1-23 week during a regular or summer session. 2-1 (c) Subsection (a) takes effect on the first January 1 on 2-2 which or following the date on which: 2-3 (1) federal law is amended to permit the exemption of 2-4 a student employee of an institution of higher education from 2-5 social security coverage; or 2-6 (2) the comptroller, on behalf of the institutions of 2-7 higher education, enters into an agreement with the Social Security 2-8 Administration that exempts or permits this state to exempt a 2-9 student employee of an institution of higher education from social 2-10 security coverage. 2-11 (d) Not later than October 1, 1995, the comptroller shall 2-12 enter into negotiations with the Social Security Administration to 2-13 reach an agreement as provided by Subsection (c)(2). 2-14 (e) If the comptroller determines that the action described 2-15 by Subsection (c)(1) or (2) has occurred, the comptroller shall 2-16 notify the secretary of state of the determination. The secretary 2-17 of state shall publish the notice in the Texas Register. 2-18 (f) If Subsection (a) takes effect, the comptroller shall 2-19 reduce the amount appropriated from the general revenue fund to an 2-20 institution of higher education for contributions for student 2-21 employees under Section 606.064 for the biennium in which 2-22 Subsection (a) takes effect, less the portion of that amount 2-23 already transferred to the institution, by one-half. This 2-24 subsection applies only to appropriations for contributions for 2-25 student employees paid entirely from the general revenue fund. 3-1 SECTION 3. The importance of this legislation and the 3-2 crowded condition of the calendars in both houses create an 3-3 emergency and an imperative public necessity that the 3-4 constitutional rule requiring bills to be read on three several 3-5 days in each house be suspended, and this rule is hereby suspended, 3-6 and that this Act take effect and be in force from and after its 3-7 passage, and it is so enacted.
