A BILL TO BE ENTITLED
AN ACT
1-1 relating to legislative space needs and space management.
1-2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-3 SECTION 1. Subsection (b-1), Section 4.01, State Purchasing
1-4 and General Services Act (Article 601b, Vernon's Texas Civil
1-5 Statutes), is amended to read as follows:
1-6 (b-1) The space in the old State Board of Insurance State
1-7 Office Building, located on San Jacinto Street between 11th and
1-8 12th streets in Austin, the Sam Houston Building, and the John H.
1-9 Reagan Building are <is> allocated to the legislature and
1-10 legislative agencies for their use. On written notice signed by
1-11 both presiding officers and delivered to the commission, the
1-12 following buildings are allocated to the legislature and
1-13 legislative agencies to the extent described in the notice:
1-14 Lorenzo de Zavala State Library and Archives Building, Stephen F.
1-15 Austin Building, Lyndon B. Johnson Building, and William B. Travis
1-16 Building. On receipt of notice under this section, the commission
1-17 shall begin immediately to undertake the relocation of agencies
1-18 occupying space in buildings allocated to legislative use. The
1-19 space must be made available for legislative use on a date
1-20 determined by the presiding officers. The presiding officers of
1-21 each house of the legislature shall jointly decide the allocation
1-22 of the space within each <the> building.
1-23 SECTION 2. Section 27, Texas Public Finance Authority Act
1-24 (Article 601d, Vernon's Texas Civil Statutes), is amended to read
2-1 as follows:
2-2 Sec. 27. <PURCHASE AND RENOVATION OF TEXAS EMPLOYMENT
2-3 COMMISSION PROPERTY.> (a) The construction of a legislative
2-4 services office building <Texas Employment Commission shall sell to
2-5 the commission office buildings and parking facilities in its
2-6 possession in or near the Capitol Complex, and the commission shall
2-7 purchase and renovate the buildings> and parking facilities, at an
2-8 estimated cost of $46,000,000,<. The purchase and renovation> is
2-9 approved for financing in accordance with Section 9 of this Act and
2-10 bonds may be issued to finance the construction <purchase and
2-11 renovation> in accordance with Section 10 of this Act.
2-12 (b) <After the office buildings have been acquired, the
2-13 commission may, from funds made available by the authority,
2-14 renovate the facilities as necessary for occupancy in accordance
2-15 with the allocation of space within the building made under
2-16 Subsection (c) of this section. In negotiating the price for the
2-17 Texas Employment Commission facilities, the commission shall
2-18 consider the cost to the Texas Employment Commission of alternative
2-19 space outside the Capitol Complex. The commission shall also
2-20 consider the price in the context of the reasonable rates that
2-21 might otherwise be paid by prospective occupying state agencies for
2-22 rent in comparable space.>
2-23 <(c)> The space in the office building <buildings> and
2-24 parking facilities is allocated to the legislature and legislative
2-25 agencies for their use. The presiding officers of each house of
2-26 the legislature shall jointly decide the allocation of the space
2-27 within the building <buildings> and facilities.
3-1 SECTION 3. The importance of this legislation and the
3-2 crowded condition of the calendars in both houses create an
3-3 emergency and an imperative public necessity that the
3-4 constitutional rule requiring bills to be read on three several
3-5 days in each house be suspended, and this rule is hereby suspended,
3-6 and that this Act take effect and be in force from and after its
3-7 passage, and it is so enacted.
