                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to the training of food service workers.
    1-2        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-3        SECTION 1.  Section 438.043, Health and Safety Code, is
    1-4  amended by adding Subsection 438.043(e) to read as follows:
    1-5        (e)  The department may modify the requirements of
    1-6  Subsections (a), (b) and (c) for a course used in training
    1-7  employees under the common control of a single entity.
    1-8        SECTION 2.  Section 438.046(b), Health and Safety Code, is
    1-9  amended to read as follows:
   1-10        (b)  A local health jurisdiction that requires training for a
   1-11  food service worker shall accept as sufficient to meet the
   1-12  jurisdiction's training and testing requirements a training course
   1-13  that is accredited by the department and listed with the registry.
   1-14  A food service worker trained in a course for the employees of a
   1-15  single entity shall be deemed to have met a local jurisdiction's
   1-16  training and testing requirements only as to food service performed
   1-17  for that entity.
   1-18        SECTION 3.  The importance of this legislation and the
   1-19  crowded condition of the calendars in both houses create an
   1-20  emergency and an imperative public necessity that the
   1-21  constitutional rule requiring bills to be read on three several
   1-22  days in each house be suspended, and this rule is hereby suspended.
