No. 1157 A BILL TO BE ENTITLED AN ACT 1-1 relating to the administration of medical and dental units of 1-2 public institutions of higher education. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Subchapter Z, Chapter 51, Education Code, is 1-5 amended by adding Section 51.932 to read as follows: 1-6 Sec. 51.932. RETIREMENT INCENTIVES. (a) A medical and 1-7 dental unit may offer retirement incentives to employees of the 1-8 unit who are eligible to retire under Subtitle C, Title 8, 1-9 Government Code. 1-10 (b) A medical and dental unit offering retirement incentives 1-11 shall provide the Legislative Budget Board with such information 1-12 concerning the incentives as may be required by the board, and 1-13 shall file any incentives plan with the board at least sixty days 1-14 before the date the plan is implemented. 1-15 (c) An employee receiving retirement incentives under this 1-16 section may not be rehired by a medical and dental unit without the 1-17 specific approval of the president of the unit. The president may 1-18 not delegate this responsibility to any other employee of the unit. 1-19 (d) Any retirement incentive offered by a medical and dental 1-20 unit must be paid from institutional funds or hospital or clinic 1-21 fees. 1-22 (e) A retirement incentive paid by a medical and dental unit 1-23 to a person is not subject to any provision of state law that 2-1 entitles a person to any benefits based on salary or compensation, 2-2 including but not limited to contributions provided for in Subtitle 2-3 C, Title 8, Government Code. 2-4 (f) As used in this section: 2-5 (1) "Institutional funds" has the meaning assigned by 2-6 Sec. 51.009, Education Code. 2-7 (2) "Medical and dental unit" has the meaning assigned 2-8 by Section 61.003, Education Code and includes any health care 2-9 facility operated by a medical and dental unit or health science 2-10 center. 2-11 SECTION 2. The Legislative Audit Committee may hire an 2-12 independent firm to report to it on the purchasing operations of a 2-13 medical and dental unit. The medical and dental unit shall 2-14 cooperate with the firm hired to do the report and shall bear the 2-15 costs of the study as determined by the Legislative Audit 2-16 Committee. As used in this section, "medical and dental unit" has 2-17 the meaning assigned by Section 61.003, Education Code and includes 2-18 any health care facility operated by a medical and dental unit or 2-19 health science center. 2-20 SECTION 3. The importance of this legislation and the 2-21 crowded condition of the calendars in both houses create an 2-22 emergency and an imperative public necessity that the 2-23 constitutional rule requiring bills to be read on three several 2-24 days in each house be suspended, and this rule is hereby suspended, 2-25 and that this Act take effect and be in force from and after its 3-1 passage, and it is so enacted.
