                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to credit in the Teacher Retirement System of Texas for
    1-3  service previously credited in the optional retirement program.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 823.202, Government Code, is amended by
    1-6  amending Subsection (a) and adding Subsection (d) to read as
    1-7  follows:
    1-8        (a)  An employee who has previously executed and filed a
    1-9  waiver of membership in the retirement system, including an
   1-10  election under Section 830.102, and who, after the waiver, becomes
   1-11  a member may establish membership service credit for service as an
   1-12  employee that would have been creditable as membership service when
   1-13  performed except for the waiver.
   1-14        (d)  Credit may not be established under this section for
   1-15  service for which contributions remain in the optional retirement
   1-16  program established by Chapter 830.
   1-17        SECTION 2.  The importance of this legislation and the
   1-18  crowded condition of the calendars in both houses create an
   1-19  emergency and an imperative public necessity that the
   1-20  constitutional rule requiring bills to be read on three several
   1-21  days in each house be suspended, and this rule is hereby suspended,
   1-22  and that this Act take effect and be in force from and after its
   1-23  passage, and it is so enacted.
