                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to unannounced inspections made by certain health and
    1-2  human services agencies.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Subchapter B, Chapter 12, Health and Safety Code,
    1-5  is amended by adding Section 12.017 to read as follows:
    1-6        Sec. 12.017.  UNANNOUNCED INSPECTIONS.  The department may
    1-7  make any inspection of a facility or program under the department's
    1-8  jurisdiction without announcing the inspection.
    1-9        SECTION 2.  Subchapter A, Chapter 533, Health and Safety
   1-10  Code, is amended by adding Section 533.015 to read as follows:
   1-11        Sec. 533.015.  UNANNOUNCED INSPECTIONS.  The department may
   1-12  make any inspection of a facility or program under the department's
   1-13  jurisdiction without announcing the inspection.
   1-14        SECTION 3.  Chapter 22, Human Resources Code, is amended by
   1-15  adding Section 22.025 to read as follows:
   1-16        Sec. 22.025.  UNANNOUNCED INSPECTIONS.  The department may
   1-17  make any inspection of a facility or program under the department's
   1-18  jurisdiction without announcing the inspection.
   1-19        SECTION 4.  The importance of this legislation and the
   1-20  crowded condition of the calendars in both houses create an
   1-21  emergency and an imperative public necessity that the
   1-22  constitutional rule requiring bills to be read on three several
   1-23  days in each house be suspended, and this rule is hereby suspended,
   1-24  and that this Act take effect and be in force from and after its
    2-1  passage, and it is so enacted.
