   1-14                         A BILL TO BE ENTITLED
   1-15                                AN ACT
   1-16  relating to unannounced inspections made by certain health and
   1-17  human services agencies.
   1-18        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-19        SECTION 1.  Subchapter B, Chapter 12, Health and Safety Code,
   1-20  is amended by adding Section 12.017 to read as follows:
   1-21        Sec. 12.017.  UNANNOUNCED INSPECTIONS.  The department may
   1-22  make any authorized inspection of a facility or program under the
   1-23  department's jurisdiction without announcing the inspection.
   1-24        SECTION 2.  Subchapter A, Chapter 533, Health and Safety
   1-25  Code, is amended by adding Section 533.015 to read as follows:
   1-26        Sec. 533.015.  UNANNOUNCED INSPECTIONS.  The department may
   1-27  make any authorized inspection of a facility or program under the
   1-28  department's jurisdiction without announcing the inspection.
   1-29        SECTION 3.  Chapter 22, Human Resources Code, is amended by
   1-30  adding Section 22.025 to read as follows:
   1-31        Sec. 22.025.  UNANNOUNCED INSPECTIONS.  The department may
   1-32  make any authorized inspection of a facility or program under the
   1-33  department's jurisdiction without announcing the inspection.
   1-34        SECTION 4.  The importance of this legislation and the
   1-35  crowded condition of the calendars in both houses create an
   1-36  emergency and an imperative public necessity that the
   1-37  constitutional rule requiring bills to be read on three several
   1-38  days in each house be suspended, and this rule is hereby suspended,
   1-39  and that this Act take effect and be in force from and after its
   1-40  passage, and it is so enacted.
