A BILL TO BE ENTITLED
AN ACT
1-1 relating to the provision of multifamily residential housing
1-2 development units for occupancy by individuals and families of low
1-3 and very low income.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Chapter 2306, Government Code, is amended by
1-6 adding Section 2306.184 to read as follows:
1-7 Section 2306.184. HOUSING FOR INDIVIDUALS AND FAMILIES OF
1-8 LOW AND VERY LOW INCOME. The department shall collect an annual
1-9 fee equal to $10 per month per unit for each unit in a multifamily
1-10 residential housing development built, renovated or refinanced
1-11 under any program administered by the department or with the
1-12 proceeds of tax exempt bonds, whether or not such bonds are private
1-13 activity bonds, issued by or on behalf of any issuer in the state,
1-14 if the multifamily residential housing development: (1) contains
1-15 at least 50 units; and (2) is financed or refinanced in whole or in
1-16 part on or after the effective date of this Act. The department
1-17 shall collect the fee annually from the developer of the
1-18 multifamily residential housing development. The department shall
1-19 deposit all funds received under this subsection to the credit of
1-20 the Housing Trust Fund established under Section 2306.201.
1-21 SECTION 2. The importance of this legislation and the
1-22 crowded condition of the calendars in both houses create an
1-23 emergency and an imperative public necessity that the
2-1 constitutional rule requiring bills to be read on three several
2-2 days in each house be suspended, and this rule is hereby suspended,
2-3 and that this Act take effect and be in force from and after its
2-4 passage, and it is so enacted.
