                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to information to be provided on application for original,
    1-2  renewal, or duplicate driver's licenses and personal identification
    1-3  cards; requiring all license applicants, including applicants
    1-4  younger than 17 years of age, to provide fingerprints and other
    1-5  required information.
    1-6        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-7        SECTION 1.  Section 6, Chapter 173, Acts of the 47th
    1-8  Legislature, Regular Session, 1941 (Article 6687b, Vernon's Texas
    1-9  Civil Statutes), is amended by adding Subsection (d) to read as
   1-10  follows:
   1-11        (d)  All applicants for an original, renewal, or duplicate
   1-12  driver's license may be required by the Department to furnish the
   1-13  information required under Subsection (b) of this section.
   1-14        SECTION 2.  Subsection (b), Section 14A, Chapter 173, Acts of
   1-15  the 47th Legislature, Regular Session, 1941 (Article 6687b,
   1-16  Vernon's Texas Civil Statutes), is amended to read as follows:
   1-17        (b)  All applicants for original, renewal, or duplicate
   1-18  <Original applications and applications for renewal of>
   1-19  identification cards may be required by the Department to furnish
   1-20  the information required under Section 6(b) of this Act <shall
   1-21  require information and be submitted on a form promulgated by the
   1-22  Department>.
   1-23        SECTION 3.  Subsections (f) and (g), Section 18, Chapter 173,
    2-1  Acts of the 47th Legislature, Regular Session, 1941 (Article 6687b,
    2-2  Vernon's Texas Civil Statutes), are amended to read as follows:
    2-3        (f)  <All applicants for renewal may be required by the
    2-4  Department to furnish the information required under Section 6(b)
    2-5  of this Act.>
    2-6        <(g)>  Except as provided by this subsection, the department
    2-7  may by rule provide that a person with a driver's license that
    2-8  expires after January 1, 1984, may renew the license by mail.  A
    2-9  rule adopted under this subsection may not permit renewal by mail
   2-10  of a provisional or occupational license and may not permit renewal
   2-11  of a license by mail if the person's individual driving record as
   2-12  maintained by the department shows that the person, within four
   2-13  years preceding the date of application for renewal, has been
   2-14  convicted of:
   2-15              (1)  a moving violation, as the department may by rule
   2-16  define, committed in this state; or
   2-17              (2)  an offense described by Section 24 of this Act.
   2-18        SECTION 4.  Section 51.15, Family Code, is amended by adding
   2-19  Subsection (j) to read as follows:
   2-20        (j)  This section does not apply to fingerprints which are
   2-21  required or authorized to be submitted or obtained on application
   2-22  for a driver's license or personal identification card.
   2-23        SECTION 5.  Actions of the Department of Public Safety of the
   2-24  State of Texas which occurred before the effective date of this Act
   2-25  and relate to information required for driver's license
    3-1  applications are validated as of the dates they occurred.
    3-2        SECTION 6.  The importance of this legislation and the
    3-3  crowded condition of the calendars in both houses create an
    3-4  emergency and an imperative public necessity that the
    3-5  constitutional rule requiring bills to be read on three several
    3-6  days in each house be suspended, and this rule is hereby suspended,
    3-7  and that this Act take effect and be in force from and after its
    3-8  passage, and it is so enacted.
