                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to the ownership, operation, or provision of a cable
    1-2  television service by a general-law municipality.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Subchapter Z, Chapter 402, Local Government Code,
    1-5  is amended by adding Section 402.905 to read as follows:
    1-6        Sec. 402.905.  OPERATION OF CABLE TELEVISION SERVICE BY A
    1-7  GENERAL-LAW MUNICIPALITY.  (a)  A general-law municipality may own,
    1-8  operate, or provide a cable television service inside or outside
    1-9  the municipal boundaries.
   1-10        (b)  The municipality shall regulate the system in a manner
   1-11  that protects the municipality's interests.
   1-12        (c)  In this section, "cable television service" means a
   1-13  service provided by or through a facility of a cable television
   1-14  system, closed-circuit coaxial cable communication system, or
   1-15  microwave or similar transmission service used in connection with a
   1-16  cable television system.
   1-17        SECTION 2.  This Act takes effect September 1, 1995.
   1-18        SECTION 3.  The importance of this legislation and the
   1-19  crowded condition of the calendars in both houses create an
   1-20  emergency and an imperative public necessity that the
   1-21  constitutional rule requiring bills to be read on three several
   1-22  days in each house be suspended, and this rule is hereby suspended.
