                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to the notice of a proposed rule requirement in the
    1-2  Administrative Procedure Act.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 2001.025, Government Code, is amended to
    1-5  read as follows:
    1-6        Sec. 2001.025.  Effective Date of Notice.  Notice of a
    1-7  proposed rule becomes effective as notice only when each item
    1-8  required to be included by Section 2001.024 is published in the
    1-9  Texas Register, except as provided by Section 2001.028.
   1-10        SECTION 2.  Subsection (a), Section 2001.035, Government
   1-11  Code, is amended to read as follows:
   1-12        (a)  A rule adopted after January 1, 1976, is not valid
   1-13  unless a state agency adopts it in substantial compliance with
   1-14  Sections 2001.023 through 2001.034.  A rule proposed and adopted
   1-15  after September 1, 1995, is not adopted in substantial compliance
   1-16  with Sections 2001.024 and 2001.025 if its notice published in the
   1-17  Texas Register does not include each item required to be included
   1-18  by Section 2001.024.
   1-19        SECTION 3.  This Act takes effect September 1, 1995.
   1-20        SECTION 4.  The importance of this legislation and the
   1-21  crowded condition of the calendars in both houses create an
   1-22  emergency and an imperative public necessity that the
   1-23  constitutional rule requiring bills to be read on three several
    2-1  days in each house be suspended, and this rule is hereby suspended.
