By: Haywood S.B. No. 1356 A BILL TO BE ENTITLED AN ACT 1-1 relating to the commingling of oil and gas production. 1-2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-3 SECTION 1. Subsection (b), Section 85.046, Natural Resources 1-4 Code, is amended to read as follows: 1-5 (b) Notwithstanding the provisions contained in this section 1-6 or elsewhere in this code or in other statutes or laws, the 1-7 commission may permit production by commingling oil or gas or oil 1-8 and gas from multiple stratigraphic or lenticular accumulations of 1-9 oil or gas or oil and gas where the commission, after notice and 1-10 opportunity for hearing, has found that producing oil or gas or oil 1-11 and gas in a commingled state will prevent waste, promote 1-12 conservation, or protect correlative rights. 1-13 SECTION 2. Subsection (b), Section 86.012, Natural Resources 1-14 Code, is amended to read as follows: 1-15 (b) Notwithstanding the provisions contained in this section 1-16 or elsewhere in this code or in other statutes or laws, the 1-17 commission may permit production by commingling oil or gas or oil 1-18 and gas from multiple stratigraphic or lenticular accumulations of 1-19 oil or gas or oil and gas where the commission, after notice and 1-20 opportunity for hearing, has found that producing oil or gas or oil 1-21 and gas in a commingled state will prevent waste, promote 1-22 conservation, or protect correlative rights. 1-23 SECTION 3. This Act takes effect September 1, 1995. 2-1 SECTION 4. The importance of this legislation and the 2-2 crowded condition of the calendars in both houses create an 2-3 emergency and an imperative public necessity that the 2-4 constitutional rule requiring bills to be read on three several 2-5 days in each house be suspended, and this rule is hereby suspended.
