By: Haywood S.B. No. 1356 A BILL TO BE ENTITLED AN ACT 1-1 relating to the commingling of oil and gas production. 1-2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-3 SECTION 1. Section 85.046(b), Natural Resources Code, is 1-4 amended to read as follows: 1-5 Sec. 85.046(b) Notwithstanding the provisions contained in 1-6 this section or elsewhere in this code or in other statutes or 1-7 laws, the commission may permit production by commingling oil or 1-8 gas or oil and gas from multiple stratigraphic or linticular 1-9 accumulations of oil or gas or oil and gas where the commission, 1-10 after notice and opportunity for hearing, has found that producing 1-11 oil or gas or oil and gas in a commingled state will prevent waste, 1-12 promote conservation, or protect correlative rights. 1-13 SECTION 2. Section 86.012(b), Natural Resources Code, is 1-14 amended to read as follows: 1-15 Sec. 86.012(b) Notwithstanding the provisions contained in 1-16 this section or elsewhere in this code or in other statutes or 1-17 laws, the commission may permit production by commingling oil or 1-18 gas or oil and gas from multiple stratigraphic or lenticular 1-19 accumulations of oil or gas or oil and gas where the commission, 1-20 after notice and opportunity for hearing, has found that producing 1-21 oil or gas or oil and gas in a commingled state will prevent waste, 1-22 promote conservation, or protect correlative rights. 1-23 SECTION 3. This Act takes effect September 1, 1995. 2-1 SECTION 4. The importance of this legislation and the 2-2 crowded condition of the calendars in both houses create an 2-3 emergency and an imperative public necessity that the 2-4 constitutional rule requiring bills to be read on three several 2-5 days in each house be suspended, and this rule is hereby suspended.
