                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to computation of benefits for retiring members of the
    1-3  Employees Retirement System of Texas; providing for appropriation
    1-4  reductions.
    1-5        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-6        SECTION 1.  Sections 814.1051(b) and (f), Government Code,
    1-7  are amended to read as follows:
    1-8        (b)  A member eligible to retire under this section is one
    1-9  who:
   1-10              (1)  meets minimum age and service requirements under
   1-11  Section 814.104;
   1-12              (2)  applies for service retirement;
   1-13              (3)  holds a position included in the employee class of
   1-14  membership on the date the application is filed; and
   1-15              (4)  designates an effective date of retirement that is
   1-16  after August 31, 1995 <1993>, but before September 1, 1997 <1995>,
   1-17  and is the later of September 30, 1995 <1993>, or the earliest date
   1-18  that the member's retirement may become effective.
   1-19        (f)  This section expires September 1, 1997 <1995>.
   1-20        SECTION 2.  Section 814.1071(c), Government Code, is amended
   1-21  to read as follows:
   1-22        (c)  This section expires September 1, 1997 <1995>.
   1-23        SECTION 3.  (a)  The comptroller shall identify to the
   1-24  Legislative Budget Board state agencies that have achieved salary
    2-1  savings because of service retirements  under Section 814.1051,
    2-2  Government Code, as amended by this Act, and the amounts of the
    2-3  savings.
    2-4        (b)  After receiving information under Subsection (a) of this
    2-5  section, the Legislative Budget Board shall reduce appropriations
    2-6  made for the fiscal years ending August 31, 1996, and August 31,
    2-7  1997, to specified agencies that have achieved salary savings under
    2-8  Section 814.1051, Government Code, as amended by this Act.  The
    2-9  board shall make reductions in general revenue appropriations of at
   2-10  least $13,411,000 not later than November 1, 1995, and additional
   2-11  reductions of at least $27,340,000 not later than November 1, 1996.
   2-12        (c)  If the Legislative Budget Board does not make reductions
   2-13  in the amounts and within the periods provided by Subsection (b) of
   2-14  this section, the comptroller shall make across-the-board
   2-15  reductions on all agencies' appropriations to achieve a total
   2-16  general revenue reduction for the fiscal biennium ending August 31,
   2-17  1997, of $40,751,000.
   2-18        SECTION 4.  This Act takes effect September 1, 1995.
   2-19        SECTION 5.  The importance of this legislation and the
   2-20  crowded condition of the calendars in both houses create an
   2-21  emergency and an imperative public necessity that the
   2-22  constitutional rule requiring bills to be read on three several
   2-23  days in each house be suspended, and this rule is hereby suspended.
