                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to notice requirements for matters within the jurisdiction
    1-2  of the Texas Natural Resource Conservation Commission.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Subchapter D, Chapter 5, Water Code, is amended
    1-5  by adding Section 5.122 to read as follows:
    1-6        Sec. 5.122.  NOTICE. (a)  The commission by rule shall adopt
    1-7  notice requirements related to matters within the commission's
    1-8  jurisdiction, including notice of applications received by the
    1-9  commission.
   1-10        (b)  The notice requirements for an application for a permit
   1-11  or other authorization or for a variance or exemption must be, to
   1-12  the extent practicable and consistent with federal and state law,
   1-13  uniform when compared to the notice requirements for an application
   1-14  for a similar permit, authorization, variance, or exemption issued
   1-15  by the commission.
   1-16        (c)  The commission shall consider and the rules may reflect
   1-17  the differing needs for notice for different matters for which a
   1-18  person may apply for a permit, authorization, variance, or
   1-19  exemption issued by the commission.
   1-20        SECTION 2.  This Act takes effect September 1, 1995.
   1-21        SECTION 3.  The importance of this legislation and the
   1-22  crowded condition of the calendars in both houses create an
   1-23  emergency and an imperative public necessity that the
    2-1  constitutional rule requiring bills to be read on three several
    2-2  days in each house be suspended, and this rule is hereby suspended.
