1-7 Amend S.B. No. 1411 on page 1, line 13 (committee printing page 1,
1-8 line 31) by putting a period after the words "geographic areas",
1-9 deleting the word "which", and inserting the words "The value of
1-10 credits for male vehicle operators under 25 years of age and for
1-11 all vehicle operators 65 years of age or older shall be not less
1-12 than one credit for the voluntary writing of one vehicle in these
1-13 classes. The value of credits for underserved geographic areas"
1-14 before the word "shall"
1-15 A BILL TO BE ENTITLED
1-16 AN ACT
1-17 relating to incentive programs to minimize the use of the Texas
1-18 Automobile Insurance Plan Association.
1-19 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-20 SECTION 1. Subsection (e), Section 3, Article 21.81,
1-21 Insurance Code, is amended to read as follows:
1-22 (e) Among other provisions, the plan of operation must
1-23 contain incentive programs to encourage members to write insurance
1-24 on a voluntary basis and to minimize the use of the association as
1-25 a means to obtain insurance. The incentive programs are effective
1-26 on approval of the commissioner. Among such approved incentive
1-27 programs shall be those that recognize the voluntary writing of
1-28 bodily injury and property damage liability insurance for male
1-29 vehicle operators under 25 years of age, for all vehicle operators
1-30 65 years of age or older, and for vehicle operators in <One of
1-31 these programs shall target> underserved geographic areas which
1-32 shall be determined and designated by the commissioner by rule. In
1-33 determining which areas will be designated as underserved, the
1-34 commissioner shall consider the availability of insurance, the
1-35 number of uninsured drivers, the number of drivers insured through
1-36 the association, and any other relevant factor.
1-37 SECTION 2. The importance of this legislation and the
1-38 crowded condition of the calendars in both houses create an
1-39 emergency and an imperative public necessity that the
1-40 constitutional rule requiring bills to be read on three several
1-41 days in each house be suspended, and this rule is hereby suspended.
