                                 A BILL TO BE ENTITLED
                                        AN ACT
1-1 relating to the testing of certain employees who are exposed to a
1-2 reportable disease and eligibility for worker's compensation.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Section 85.116(c), Health and Safety Code, is
1-5 amended to read as follows:
1-6 (c) For the purpose of qualifying for workers' compensation
1-7 or any other similar benefits or compensation, an employee who
1-8 claims a possible work-related exposure to HIV infection must
1-9 provide the employer with a written statement of the date and
1-10 circumstances of the exposure and document that, within 15 <10>
1-11 days after the date of the exposure, the employee had a test result
1-12 that indicated an absence of HIV infection.
1-13 SECTION 2. EMERGENCY CLAUSE. The importance of this
1-14 legislation and the crowded condition of the calendars in both
1-15 houses create an emergency and an imperative public necessity that
1-16 the constitutional rule requiring bills to be read on three several
1-17 days in each house be suspended, and this rule is hereby suspended,
1-18 and that this Act take effect and be in force according to its
1-19 terms, and it is so enacted.
