                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to a fee charged on solid waste disposal dedicated to the
    1-2  support of the school district in which a landfill is located.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Subchapter B, Chapter 361, Health and Safety
    1-5  Code, is amended by adding Section 361.0131 to read as follows:
    1-6        Sec. 361.0131.  SCHOOL DISTRICT DEDICATED SOLID WASTE
    1-7  DISPOSAL FEE.  (a)  In addition to the fee charged under Section
    1-8  361.013(a), the department shall charge a fee on solid waste that
    1-9  is disposed of within this state to be dedicated to the school
   1-10  district in which a landfill is located.  The fee is $1 per ton
   1-11  received for disposal at a landfill if the solid waste is measured
   1-12  by weight.  If the solid waste is measured by volume, the fee for
   1-13  compacted solid waste is 32 cents per cubic yard or, for
   1-14  uncompacted solid waste, 20 cents per cubic yard received for
   1-15  disposal at a landfill.
   1-16        (b)  Revenue received by the department under this section
   1-17  shall be deposited in the state treasury to the credit of the
   1-18  department in an account from which funds are to be transferred by
   1-19  the department to the school district in which the fee was
   1-20  collected on a  quarterly basis.
   1-21        SECTION 2.  This Act takes effect September 1, 1995.
   1-22        SECTION 3.  The importance of this legislation and the
   1-23  crowded condition of the calendars in both houses create an
    2-1  emergency and an imperative public necessity that the
    2-2  constitutional rule requiring bills to be read on three several
    2-3  days in each house be suspended, and this rule is hereby suspended.
