No. 1495 74R7979 JRD-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to transferring money and to reducing the appropriations 1-3 of certain state agencies for the fiscal year ending August 31, 1-4 1995, to reflect the savings and reimbursements to the state under 1-5 a contract for computer services; making an appropriation. 1-6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-7 SECTION 1. (a) The comptroller of public accounts shall 1-8 reduce for the fiscal year ending August 31, 1995, the 1-9 appropriation of each state agency that saves money under a 1-10 contract that was entered into by the Department of Information 1-11 Resources with a private vendor at the direction of the State 1-12 Council on Competitive Government for the provision of computer 1-13 services that were previously provided by the computer services 1-14 facility of the department. The aggregate amount of the 1-15 appropriations to be reduced under this subsection is $563,233. 1-16 (b) The comptroller shall reduce an affected agency's 1-17 appropriation in an amount equal to the amount of money the agency 1-18 will save as a result of the contract during the fiscal year ending 1-19 August 31, 1995. 1-20 (c) The comptroller shall transfer to the undedicated 1-21 portion of the general revenue fund the $563,233 in appropriations 1-22 reduced under Subsections (a) and (b) of this section. 1-23 (d) The comptroller also shall credit to the general revenue 1-24 fund the amount of money that is paid under the contract by the 2-1 vendor to the Department of Information Resources during the fiscal 2-2 year ending August 31, 1995, for the reimbursement of the state's 2-3 direct and indirect costs related to the contract, which amount is 2-4 estimated to be $612,986. Out of that amount: 2-5 (1) there is appropriated for the fiscal year ending 2-6 August 31, 1995, to the General Services Commission an amount equal 2-7 to the extra costs incurred by the commission as a result of the 2-8 contract during that fiscal year for the purpose of paying those 2-9 extra costs; and 2-10 (2) there is appropriated for the fiscal year ending 2-11 August 31, 1995, to the Department of Information Resources an 2-12 amount equal to the extra costs incurred by the department as a 2-13 result of the contract during that fiscal year for the purpose of 2-14 paying those extra costs. 2-15 SECTION 2. The importance of this legislation and the 2-16 crowded condition of the calendars in both houses create an 2-17 emergency and an imperative public necessity that the 2-18 constitutional rule requiring bills to be read on three several 2-19 days in each house be suspended, and this rule is hereby suspended, 2-20 and that this Act take effect and be in force from and after its 2-21 passage, and it is so enacted.
