    1-8  renumbering SECTION 2 as SECTION 1.
    1-9                         A BILL TO BE ENTITLED
   1-10                                AN ACT
   1-11  relating to the transportation and disposal of low-level
   1-12  radioactive waste.
   1-13        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-14        SECTION 1.  Subchapter C, Chapter 401, Health and Safety
   1-15  Code, is amended by adding Section 401.0521 to read as follows:
   1-16        Sec. 401.0521.  CERTAIN LOW-LEVEL WASTE TRANSPORTATION ROUTES
   1-17  PROHIBITED.  (a)  A person may not transport low-level waste
   1-18  through a municipality with a population of more than 50,000 except
   1-19  as provided by Subsection (b).
   1-20        (b)  A person may transport low-level waste through the
   1-21  municipality in which the waste was generated.
   1-22        (c)  In this section, "low-level waste" has the meaning
   1-23  assigned by Section 402.003.
   1-24        SECTION 2.  Subchapter H, Chapter 402, Health and Safety
   1-25  Code, is amended by adding Section 402.2255 to read as follows:
   1-26        Sec. 402.2255.  INCINERATION OF LOW-LEVEL WASTE.  (a)  A
   1-27  person may not dispose of low-level waste by incineration in a
   1-28  county with a population of less than 3,000.
   1-29        (b)  The authority shall adopt rules to enforce this section.
   1-30        SECTION 3.  The importance of this legislation and the
   1-31  crowded condition of the calendars in both houses create an
   1-32  emergency and an imperative public necessity that the
   1-33  constitutional rule requiring bills to be read on three several
   1-34  days in each house be suspended, and this rule is hereby suspended,
   1-35  and that this Act take effect and be in force from and after its
   1-36  passage, and it is so enacted.
