    1-6                         A BILL TO BE ENTITLED
    1-7                                AN ACT
    1-8  relating to the acquisition by the Parks and Wildlife Department of
    1-9  real property owned by the permanent school fund.
   1-10        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-11        SECTION 1.  The Parks and Wildlife Department shall acquire,
   1-12  by purchase or exchange for fair market value, all of the real
   1-13  property owned by the permanent school fund located within Franklin
   1-14  Mountains State Park in El Paso County, Texas (as the boundaries of
   1-15  the park are established in Section 2, Chapter 736, Acts of the
   1-16  66th Legislature, as amended by Section 2, Chapter 860, Acts of the
   1-17  67th Legislature, Regular Session, 1981, and Sections 1 and 2,
   1-18  Chapter 383, Acts of the 71st Legislature, Regular Session, 1989)
   1-19  by deed from the permanent school fund.  The real property owned by
   1-20  the permanent school fund located within Franklin Mountains State
   1-21  Park is further described as:
   1-22        (A)  all of the surface and mineral interest, including all
   1-23  oil, gas, and other minerals, in the following tracts:
   1-24              (1)  Clara A. Mundy Survey No. 252;
   1-25              (2)  Clara A. Mundy Survey No. 253;
   1-26              (3)  Section 2, Block 82, Township 1, Texas and Pacific
   1-27  Railway Company Survey;
   1-28              (4)  Section 4, Block 82, Township 1, Texas and Pacific
   1-29  Railway Company Survey;
   1-30              (5)  Section 8, Block 82, Township 1, Texas and Pacific
   1-31  Railway Company Survey;
   1-32              (6)  J.A. Rogers Survey No. 400;
   1-33              (7)  W.P. Paschal Survey No. 277;
   1-34              (8)  A.G. McMath Survey No. 297;
   1-35              (9)  A.G. McMath Survey No. 298;

    2-1  all in El Paso County, Texas, and only to the extent located within
    2-2  Franklin Mountains State Park.
    2-3        SECTION 2.  The intention of this Act is that all of the real
    2-4  property owned by the permanent school fund located within Franklin
    2-5  Mountains State Park be conveyed to the Parks and Wildlife
    2-6  Department in exchange for fair market value.  The determination of
    2-7  fair market value will be in accordance with the procedures
    2-8  established in Section 32.061, Natural Resources Code.  The
    2-9  acquisition described in this Act shall be completed no later than
   2-10  December 31, 1995.
   2-11        SECTION 3.  The importance of this legislation and the
   2-12  crowded condition of the calendars in both houses create an
   2-13  emergency and an imperative public necessity that the
   2-14  constitutional rule requiring bills to be read on three several
   2-15  days in each house be suspended, and this rule is hereby suspended.
