                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to abolishing the fee on the sale of automotive oil.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 371.043(c), Health and Safety Code, is
    1-5  amended to read as follows:
    1-6        (c)  The penalty imposed by this section does not apply to
    1-7  <failure to pay a fee under Section 371.062 or> failure to file a
    1-8  report under Section 371.024 or 371.026.
    1-9        SECTION 2.  Section 371.061(b), Health and Safety Code, is
   1-10  amended to read as follows:
   1-11        (b)  The fund consists of:
   1-12              (1)  fees collected under Sections 371.024  and<,>
   1-13  371.026<, and 371.062>;
   1-14              (2)  interest and penalties imposed under this chapter
   1-15  for late payment of fees, failure to file a report, or other
   1-16  violations of this chapter;  and
   1-17              (3)  gifts, grants, donations, or other financial
   1-18  assistance the department is authorized to receive under Section
   1-19  371.027.
   1-20        SECTION 3.  Section 371.062, Health and Safety Code, is
   1-21  repealed.
   1-22        SECTION 4.  (a)  This Act takes effect January 1, 1996.
   1-23        (b)  The repeal of Section 371.062, Health and Safety Code,
   1-24  by this Act does not affect the collection or enforcement of the
    2-1  fee imposed on the sale of automotive oil under that section before
    2-2  the effective date of this Act, and the law in effect before the
    2-3  effective date of this Act is continued in effect for purposes of
    2-4  the liability for and collection of that fee.
    2-5        SECTION 5.  The importance of this legislation and the
    2-6  crowded condition of the calendars in both houses create an
    2-7  emergency and an imperative public necessity that the
    2-8  constitutional rule requiring bills to be read on three several
    2-9  days in each house be suspended, and this rule is hereby suspended.
