CREATION, ADMINISTRATION, POWERS, DUTIES, OPERATION, 1-10 AND FINANCING OF TRAVIS COUNTY MUNICIPAL UTILITY DISTRICT NO. 3. 1-11 SECTION 1.01. CREATION. (a) A conservation and reclamation 1-12 district, to be known as Travis County Municipal Utility District 1-13 No. 3, is created in Travis County, subject to approval at a 1-14 confirmation election under Section 1.09 of this article. The 1-15 district is a governmental agency and a body politic and corporate. 1-16 (b) The district is created under and is essential to 1-17 accomplish the purposes of Section 59, Article XVI, Texas 1-18 Constitution. 1-19 SECTION 1.02. DEFINITIONS. FINDING OF BENEFIT. All of the land and other 29-13 property included within the boundaries of the district will be 29-14 benefited by the works and projects that are to be accomplished by 29-15 the district under the powers conferred by Section 59, Article XVI, 29-16 Texas Constitution. The district is created to serve a public use 29-17 and benefit. 29-18 SECTION 1.06. POWERS. (a) The district has all of the 29-19 rights, powers, privileges, authority, functions, and duties 29-20 provided by the general law of this state, including Chapters 50 29-21 and 54, Water Code, applicable to municipal utility districts 29-22 created under Section 59, Article XVI, Texas Constitution. This 29-23 article prevails over any provision of general law that is in 29-24 conflict or inconsistent with this article. 29-25 (b) The rights, powers, privileges, authority, functions, 30-1 and duties of the district are subject to the continuing right of 30-2 supervision of the state to be exercised by and through the 30-3 commission. 30-4 SECTION 1.07. BOARD OF DIRECTORS. (a) The district is 30-5 governed by a board of five directors. 30-6 (b) Temporary directors serve until initial permanent 30-7 directors are elected under Section 1.09 of this article. 30-8 (c) Initial permanent directors serve until permanent 30-9 directors are elected under Section 1.10 of this article. 30-10 (d) Permanent directors other than initial permanent 30-11 directors serve staggered four-year terms. 30-12 (e) Each director must qualify to serve as director in the 30-13 manner provided by Section 54.025 or 54.116, Water Code, as 30-14 appropriate. 30-15 (f) A director serves until the director's successor has 30-16 qualified. 30-17 SECTION 1.08. TEMPORARY DIRECTORS. (a) The temporary board 30-18 of directors is composed of: 30-19 (1) W. Scott Norman, Jr. 30-20 (2) Clay Morgan 30-21 (3) Doug Fike 30-22 (4) Marshall Kuykendall, Jr. 30-23 (5) Bill Wendlendt 30-24 (b) If a temporary director fails to qualify for office, the 30-25 temporary directors who have qualified shall appoint a person to 31-1 fill the vacancy. If at any time there are fewer than three 31-2 qualified temporary directors, the commission shall appoint the 31-3 necessary number of persons to fill all vacancies on the board. 31-4 SECTION 1.09. CONFIRMATION AND INITIAL DIRECTORS' ELECTION. 31-5 (a) The temporary board of directors shall call and hold an 31-6 election to confirm establishment of the district and to elect five 31-7 initial directors as provided by Chapter 54, Water Code. 31-8 (b) Subsection (a), Section 41.001, Election Code, does not 31-9 apply to a confirmation election held as provided by this section. 31-10 SECTION 1.10. ELECTION OF DIRECTORS. On the first Saturday 31-11 in May of the fourth year after the year in which the confirmation 31-12 election is held, an election shall be held in the district for the 31-13 election of two directors who shall each serve two-year terms and 31-14 three directors who shall serve four-year terms. Thereafter, on 31-15 the same date in each subsequent second year, the appropriate 31-16 number of directors shall be elected to the board. 31-17 SECTION 1.11. PROHIBITION AGAINST IMPAIRMENT OF DISTRICT. 31-18 No municipality in whose extraterritorial jurisdiction the district 31-19 is located shall pass any ordinances or resolutions or otherwise 31-20 take any actions which impair the ability of the district to 31-21 exercise its powers under this article or which would limit the 31-22 ability of the district to finance, construct, or operate its 31-23 water, wastewater, or drainage systems. 31-24 SECTION 1.12. ANNEXATION. The district may be annexed by a 31-25 municipality only after: 32-1 (1) the installation of 90 percent of all works, 32-2 improvements, facilities, plants, equipment, and appliances 32-3 necessary and adequate to: 32-4 (A) provide service to the proposed development 32-5 within the district; 32-6 (B) accomplish the purposes for which the 32-7 district was created; and 32-8 (C) exercise the powers provided by the general 32-9 law of this state and this article; or 32-10 (2) the expiration of 20 years from the date the 32-11 district was confirmed, whichever occurs first. 32-12 SECTION 1.13. REIMBURSEMENT TO LANDOWNER OR DEVELOPER, 32-13 INSTALLATION OF FACILITIES. If a municipality in whose 32-14 extraterritorial jurisdiction the district is located annexes the 32-15 district for full or limited purposes and the annexation precludes 32-16 or impairs the ability of the district to issue bonds, the 32-17 municipality shall, simultaneously with the annexation, pay in cash 32-18 to the landowner or developer of the district a sum equal to all 32-19 actual costs and expenses incurred by the landowner or developer in 32-20 connection with the district that the district has, in writing, 32-21 agreed to pay and that would otherwise have been eligible for 32-22 reimbursement from bond proceeds under the rules and requirements 32-23 of the commission as such rules and requirements exist on the date 32-24 of annexation. The municipality shall further be required to 32-25 install after annexation all necessary water, wastewater, and 33-1 drainage facilities to serve full buildout of development within 33-2 the district. 33-3 ARTICLE 2. CREATION, ADMINISTRATION, POWERS, DUTIES, OPERATION, 33-4 AND FINANCING OF TRAVIS COUNTY MUNICIPAL UTILITY DISTRICT NO. 4. 33-5 SECTION 2.01. CREATION. (a) A conservation and reclamation 33-6 district, to be known as Travis County Municipal Utility District 33-7 No. 4, is created in Travis County, subject to approval at a 33-8 confirmation election under Section 2.09 of this article. (a) The district has all of the 52-20 rights, powers, privileges, authority, functions, and duties 52-21 provided by the general law of this state, including Chapters 50 52-22 and 54, Water Code, applicable to municipal utility districts 52-23 created under Section 59, Article XVI, Texas Constitution. This 52-24 article prevails over any provision of general law that is in 52-25 conflict or inconsistent with this article. 53-1 (b) The rights, powers, privileges, authority, functions, 53-2 and duties of the district are subject to the continuing right of 53-3 supervision of the state to be exercised by and through the 53-4 commission. 53-5 SECTION 2.07. BOARD OF DIRECTORS. (a) The district is 53-6 governed by a board of five directors. 53-7 (b) Temporary directors serve until initial permanent 53-8 directors are elected under Section 2.09 of this article. 53-9 (c) Initial permanent directors serve until permanent 53-10 directors are elected under Section 2.10 of this article. 53-11 (d) Permanent directors other than initial permanent 53-12 directors serve staggered four-year terms. 53-13 (e) Each director must qualify to serve as director in the 53-14 manner provided by Section 54.025 or 54.116, Water Code, as 53-15 appropriate. 53-16 (f) A director serves until the director's successor has 53-17 qualified. 53-18 SECTION 2.08. TEMPORARY DIRECTORS. (a) The temporary board 53-19 of directors is composed of: 53-20 (1) John Mitchell 53-21 (2) Rick Hardin 53-22 (3) Linda Holmes 53-23 (4) J. C. Currier 53-24 (5) Jill Bickford 53-25 (b) If a temporary director fails to qualify for office, the 54-1 temporary directors who have qualified shall appoint a person to 54-2 fill the vacancy. If at any time there are fewer than three 54-3 qualified temporary directors, the commission shall appoint the 54-4 necessary number of persons to fill all vacancies on the board. 54-5 SECTION 2.09. CONFIRMATION AND INITIAL DIRECTORS' ELECTION. 54-6 (a) The temporary board of directors shall call and hold an 54-7 election to confirm establishment of the district and to elect five 54-8 initial directors as provided by Chapter 54, Water Code. 54-9 (b) Subsection (a), Section 41.001, Election Code, does not 54-10 apply to a confirmation election held as provided by this section. 54-11 SECTION 2.10. ELECTION OF DIRECTORS. On the first Saturday 54-12 in May of the fourth year after the year in which the confirmation 54-13 election is held, an election shall be held in the district for the 54-14 election of two directors who shall each serve two-year terms and 54-15 three directors who shall serve four-year terms. Thereafter, on 54-16 the same date in each subsequent second year, the appropriate 54-17 number of directors shall be elected to the board. 54-18 SECTION 2.11. PROHIBITION AGAINST IMPAIRMENT OF DISTRICT. 54-19 No municipality in whose extraterritorial jurisdiction the district 54-20 is located shall pass any ordinances or resolutions or otherwise 54-21 take any actions which impair the ability of the district to 54-22 exercise its powers under this article or which would limit the 54-23 ability of the district to finance, construct, or operate its 54-24 water, wastewater, or drainage systems. 54-25 SECTION. 2.12. ANNEXATION. The district may be annexed by a 55-1 municipality only after: 55-2 (1) the installation of 90 percent of all works, 55-3 improvements, facilities, plants, equipment, and appliances 55-4 necessary and adequate to: 55-5 (A) provide service to the proposed development 55-6 within the district; 55-7 (B) accomplish the purposes for which the 55-8 district was created; and 55-9 (C) exercise the powers provided by the general 55-10 law of this state and this article; or 55-11 (2) the expiration of 20 years from the date the 55-12 district was confirmed, whichever occurs first. 55-13 SECTION 2.13. REIMBURSEMENT TO LANDOWNER OR DEVELOPER, 55-14 INSTALLATION OF FACILITIES. If a municipality in whose 55-15 extraterritorial jurisdiction the district is located annexes the 55-16 district for full or limited purposes and the annexation precludes 55-17 or impairs the ability of the district to issue bonds, the 55-18 municipality shall, simultaneously with the annexation, pay in cash 55-19 to the landowner or developer of the district a sum equal to all 55-20 actual costs and expenses incurred by the landowner or developer in 55-21 connection with the district that the district has, in writing, 55-22 agreed to pay and that would otherwise have been eligible for 55-23 reimbursement from bond proceeds under the rules and requirements 55-24 of the commission as such rules and requirements exist on the date 55-25 of annexation. The municipality shall further be required to 56-1 install after annexation all necessary water, wastewater, and 56-2 drainage facilities to serve full buildout of development within 56-3 the district. 56-4 ARTICLE 3. BOARD OF DIRECTORS. TEMPORARY DIRECTORS. (a) The temporary board 67-17 of directors is composed of: 67-18 (1) Rob Riviere 67-19 (2) John Slais 67-20 (3) Walt Collins 67-21 (4) Chip Thomson 67-22 (5) Bill Snyder 67-23 (b) If a temporary director fails to qualify for office, the 67-24 temporary directors who have qualified shall appoint a person to 67-25 fill the vacancy. If at any time there are fewer than three 68-1 qualified temporary directors, the commission shall appoint the 68-2 necessary number of persons to fill all vacancies on the board. 68-3 SECTION 3.09. CONFIRMATION AND INITIAL DIRECTORS' ELECTION. 68-4 (a) The temporary board of directors shall call and hold an 68-5 election to confirm establishment of the district and to elect five 68-6 initial directors as provided by Chapter 54, Water Code. 68-7 (b) Subsection (a), Section 41.001, Election Code, does not 68-8 apply to a confirmation election held as provided by this section. 68-9 SECTION 3.10. ELECTION OF DIRECTORS. On the first Saturday 68-10 in May of the fourth year after the year in which the confirmation 68-11 election is held, an election shall be held in the district for the 68-12 election of two directors who shall each serve two-year terms and 68-13 three directors who shall serve four-year terms. Thereafter, on 68-14 the same date in each subsequent second year, the appropriate 68-15 number of directors shall be elected to the board. 68-16 SECTION 3.11. PROHIBITION AGAINST IMPAIRMENT OF DISTRICT. 68-17 No municipality in whose extraterritorial jurisdiction the district 68-18 is located shall pass any ordinances or resolutions or otherwise 68-19 take any actions which impair the ability of the district to 68-20 exercise its powers under this article or which would limit the 68-21 ability of the district to finance, construct, or operate its 68-22 water, wastewater, or drainage systems. 68-23 SECTION 3.12. ANNEXATION. The district may be annexed by a 68-24 municipality only after: 68-25 (1) the installation of 90 percent of all works, 69-1 improvements, facilities, plants, equipment, and appliances 69-2 necessary and adequate to: 69-3 (A) provide service to the proposed development 69-4 within the district; 69-5 (B) accomplish the purposes for which the 69-6 district was created; and 69-7 (C) exercise the powers provided by the general 69-8 law of this state and this article; or 69-9 (2) the expiration of 20 years from the date the 69-10 district was confirmed, whichever occurs first. 69-11 SECTION 3.13. REIMBURSEMENT TO LANDOWNER OR DEVELOPER, 69-12 INSTALLATION OF FACILITIES. If a municipality in whose 69-13 extraterritorial jurisdiction the district is located annexes the 69-14 district for full or limited purposes and the annexation precludes 69-15 or impairs the ability of the district to issue bonds, the 69-16 municipality shall, simultaneously with the annexation, pay in cash 69-17 to the landowner or developer of the district a sum equal to all 69-18 actual costs and expenses incurred by the landowner or developer in 69-19 connection with the district that the district has, in writing, 69-20 agreed to pay and that would otherwise have been eligible for 69-21 reimbursement from bond proceeds under the rules and requirements 69-22 of the commission as such rules and requirements exist on the date 69-23 of annexation. The municipality shall further be required to 69-24 install after annexation all necessary water, wastewater, and 69-25 drainage facilities to serve full buildout of development within 70-1 the district. 70-2 ARTICLE 4. CREATION, ADMINISTRATION, POWERS, DUTIES, OPERATION, 70-3 AND FINANCING OF TRAVIS COUNTY MUNICIPAL UTILITY DISTRICT NO. 6. 70-4 SECTION 4.01. CREATION. BOARD OF DIRECTORS. ANNEXATION. The district may be annexed by a 81-4 municipality only after: 81-5 (1) the installation of 90 percent of all works, 81-6 improvements, facilities, plants, equipment, and appliances 81-7 necessary and adequate to: 81-8 (A) provide service to the proposed development 81-9 within the district; 81-10 (B) accomplish the purposes for which the 81-11 district was created; and 81-12 (C) exercise the powers provided by the general 81-13 law of this state and this article; or 81-14 (2) the expiration of 20 years from the date the 81-15 district was confirmed, whichever occurs first. 81-16 SECTION 4.13. REIMBURSEMENT TO LANDOWNER OR DEVELOPER, 81-17 INSTALLATION OF FACILITIES. If a municipality in whose 81-18 extraterritorial jurisdiction the district is located annexes the 81-19 district for full or limited purposes and the annexation precludes 81-20 or impairs the ability of the district to issue bonds, the 81-21 municipality shall, simultaneously with the annexation, pay in cash 81-22 to the landowner or developer of the district a sum equal to all 81-23 actual costs and expenses incurred by the landowner or developer in 81-24 connection with the district that the district has, in writing, 81-25 agreed to pay and that would otherwise have been eligible for 82-1 reimbursement from bond proceeds under the rules and requirements 82-2 of the commission as such rules and requirements exist on the date 82-3 of annexation. The municipality shall further be required to 82-4 install after annexation all necessary water, wastewater, and 82-5 drainage facilities to serve full buildout of development within 82-6 the district. 82-7 ARTICLE 5. This 96-22 article prevails over any provision of general law that is in 96-23 conflict or inconsistent with this article. 96-24 (b) The rights, powers, privileges, authority, functions, 96-25 and duties of the district are subject to the continuing right of 97-1 supervision of the state to be exercised by and through the 97-2 commission. 97-3 SECTION 6.07. BOARD OF DIRECTORS. (a) The district is 97-4 governed by a board of five directors. 97-5 (b) Temporary directors serve until initial permanent 97-6 directors are elected under Section 6.09 of this article. 97-7 (c) Initial permanent directors serve until permanent 97-8 directors are elected under Section 6.10 of this article. 97-9 (d) Permanent directors other than initial permanent 97-10 directors serve staggered four-year terms. 97-11 (e) Each director must qualify to serve as director in the 97-12 manner provided by Section 54.025 or 54.116, Water Code, as 97-13 appropriate. 97-14 (f) A director serves until the director's successor has 97-15 qualified. 97-16 SECTION 6.08. TEMPORARY DIRECTORS. (a) The temporary board 97-17 of directors is composed of: 97-18 (1) John Jansing 97-19 (2) Mark Scott 97-20 (3) Dick Obenhaus 97-21 (4) Bill Skeen 97-22 (5) Tom Nelson 97-23 (b) If a temporary director fails to qualify for office, the 97-24 temporary directors who have qualified shall appoint a person to 97-25 fill the vacancy. If at any time there are fewer than three 98-1 qualified temporary directors, the commission shall appoint the 98-2 necessary number of persons to fill all vacancies on the board. 98-3 SECTION 6.09. CONFIRMATION AND INITIAL DIRECTORS' ELECTION. 98-4 (a) The temporary board of directors shall call and hold an 98-5 election to confirm establishment of the district and to elect five 98-6 initial directors as provided by Chapter 54, Water Code. 98-7 (b) Subsection (a), Section 41.001, Election Code, does not 98-8 apply to a confirmation election held as provided by this section. 98-9 SECTION 6.10. ELECTION OF DIRECTORS. On the first Saturday 98-10 in May of the fourth year after the year in which the confirmation 98-11 election is held, an election shall be held in the district for the 98-12 election of two directors who shall each serve two-year terms and 98-13 three directors who shall serve four-year terms. Thereafter, on 98-14 the same date in each subsequent second year, the appropriate 98-15 number of directors shall be elected to the board. 98-16 SECTION 6.11. PROHIBITION AGAINST IMPAIRMENT OF DISTRICT. 98-17 No municipality in whose extraterritorial jurisdiction the district 98-18 is located shall pass any ordinances or resolutions or otherwise 98-19 take any actions which impair the ability of the district to 98-20 exercise its powers under this article or which would limit the 98-21 ability of the district to finance, construct, or operate its 98-22 water, wastewater, or drainage systems. 98-23 SECTION 6.12. ANNEXATION. The district may be annexed by a 98-24 municipality only after: 98-25 (1) the installation of 90 percent of all works, 99-1 improvements, facilities, plants, equipment, and appliances 99-2 necessary and adequate to: 99-3 (A) provide service to the proposed development 99-4 within the district; 99-5 (B) accomplish the purposes for which the 99-6 district was created; and 99-7 (C) exercise the powers provided by the general 99-8 law of this state and this article; or 99-9 (2) the expiration of 20 years from the date the 99-10 district was confirmed, whichever occurs first. 99-11 SECTION 6.13. REIMBURSEMENT TO LANDOWNER OR DEVELOPER, 99-12 INSTALLATION OF FACILITIES. If a municipality in whose 99-13 extraterritorial jurisdiction the district is located annexes the 99-14 district for full or limited purposes and the annexation precludes 99-15 or impairs the ability of the district to issue bonds, the 99-16 municipality shall, simultaneously with the annexation, pay in cash 99-17 to the landowner or developer of the district a sum equal to all 99-18 actual costs and expenses incurred by the landowner or developer in 99-19 connection with the district that the district has, in writing, 99-20 agreed to pay and that would otherwise have been eligible for 99-21 reimbursement from bond proceeds under the rules and requirements 99-22 of the commission as such rules and requirements exist on the date 99-23 of annexation. The municipality shall further be required to 99-24 install after annexation all necessary water, wastewater, and 99-25 drainage facilities to serve full buildout of development within 100-1 the district. 100-2 ARTICLE 7. CREATION, ADMINISTRATION, POWERS, DUTIES, OPERATION, 100-3 AND FINANCING OF TRAVIS COUNTY MUNICIPAL UTILITY DISTRICT NO. 9. 100-4 SECTION 7.01. CREATION. (a) A conservation and reclamation 100-5 district, to be known as Travis County Municipal Utility District 100-6 No. 9, is created in Travis County, subject to approval at a 100-7 confirmation election under Section 7.09 of this article. FINDINGS; EMERGENCY 110-22 SECTION 8.01. FINDINGS RELATING TO PROCEDURAL REQUIREMENTS. 110-23 (a) The proper and legal notice of the intention to introduce this 110-24 Act, setting forth the general substance of this Act, has been 110-25 published as provided by law, and the notice and a copy of this Act 111-1 have been furnished to all persons, agencies, officials, or 111-2 entities to which they are required to be furnished by the 111-3 constitution and other laws of this state, including the governor, 111-4 who has submitted the notice and Act to the Texas Natural Resource 111-5 Conservation Commission. 111-6 (b) The Texas Natural Resource Conservation Commission has 111-7 filed its recommendations relating to this Act with the governor, 111-8 lieutenant governor, and speaker of the house of representatives 111-9 within the required time. 111-10 (c) All requirements of the constitution and laws of this 111-11 state and the rules and procedures of the legislature with respect 111-12 to the notice, introduction, and passage of this Act are fulfilled 111-13 and accomplished. 111-14 SECTION 8.02. EMERGENCY. The importance of this legislation 111-15 and the crowded condition of the calendars in both houses create an 111-16 emergency and an imperative public necessity that the 111-17 constitutional rule requiring bills to be read on three several 111-18 days in each house be suspended, and this rule is hereby suspended, 111-19 and that this Act take effect and be in force from and after its 111-20 passage, and it is so enacted.
