    1-6                         A BILL TO BE ENTITLED
    1-7                                AN ACT
    1-8  relating to service and rates of a gas utility.
    1-9        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-10        SECTION 1.  Subsection (d), Section 1, Article 6050, Revised
   1-11  Statutes, is amended to read as follows:
   1-12        (d)  No person shall be deemed to be a "gas utility," "public
   1-13  utility," or "utility" solely because such person is an affiliate
   1-14  of such an entity.  <The term "gas utility," "public utility," or
   1-15  "utility" does not include a person not otherwise a gas utility
   1-16  that transports gas on behalf of the state or a state agency or
   1-17  institution.>
   1-18        SECTION 2.  The following are repealed:
   1-19              (1)  Section 6, Article 6050, Revised Statutes; and
   1-20              (2)  Subsection (b), Section 1, Article 6053, Revised
   1-21  Statutes.
   1-22        SECTION 3.  The importance of this legislation and the
   1-23  crowded condition of the calendars in both houses create an
   1-24  emergency and an imperative public necessity that the
   1-25  constitutional rule requiring bills to be read on three several
   1-26  days in each house be suspended, and this rule is hereby suspended,
   1-27  and that this Act take effect and be in force from and after its
   1-28  passage, and it is so enacted.
