                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to establishing a speed limit on a street or highway in a
    1-3  municipality.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 169, Uniform Act Regulating Traffic on
    1-6  Highways (Article 6701d, Vernon's Texas Civil Statutes), is amended
    1-7  by adding Subsection (f) to read as follows:
    1-8        (f)  In addition to the other authority granted to the
    1-9  governing body of an incorporated city, town, or village to
   1-10  establish a speed limit, the governing body may, by ordinance
   1-11  adopted after a public hearing without an engineering or traffic
   1-12  investigation, establish for a location a prima facie speed limit
   1-13  not more than 10 miles per hour less than the prima facie speed
   1-14  limit established for that location by this article or by the
   1-15  department or governing body under the other provisions of this
   1-16  article.  This subsection applies only to a street or highway or
   1-17  part of a street or highway within the territory of the city, town,
   1-18  or village, including all or part of a highway in the state highway
   1-19  system, except that this subsection does not apply to a street or
   1-20  highway included in the Texas Highway Trunk System, as determined
   1-21  according to rules of the Texas Department of Transportation.
   1-22        SECTION 2.  The importance of this legislation and the
   1-23  crowded condition of the calendars in both houses create an
   1-24  emergency and an imperative public necessity that the
    2-1  constitutional rule requiring bills to be read on three several
    2-2  days in each house be suspended, and this rule is hereby suspended,
    2-3  and that this Act take effect and be in force from and after its
    2-4  passage, and it is so enacted.
