No. 1693 74R11411 KKA-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to authorizing the division of the Gonzales County 1-3 Underground Water Conservation District into precincts, authorizing 1-4 the board to make expenditures, and validating certain actions. 1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-6 SECTION 1. DEFINITIONS. In this Act: 1-7 (1) "Board" means the board of directors of the 1-8 Gonzales County Underground Water Conservation District. 1-9 (2) "District" means the Gonzales County Underground 1-10 Water Conservation District. 1-11 SECTION 2. DIVISION OF DISTRICT INTO SINGLE-MEMBER 1-12 PRECINCTS. The board may from time to time divide the district 1-13 into five precincts of substantially equal population for the 1-14 purpose of electing directors. Notwithstanding Section 52.102, 1-15 Water Code, the board may divide territory contained in a municipal 1-16 corporation within the district into as many precincts as necessary 1-17 to obtain precincts of substantially equal population. 1-18 SECTION 3. AUTHORITY OF BOARD COMPOSED OF TEMPORARY 1-19 DIRECTORS. Temporary directors serving on the board on the 1-20 effective date of this Act may authorize and make, through board 1-21 action, all expenditures necessary to conduct district business 1-22 until permanent directors are elected and qualify for office. 1-23 SECTION 4. VALIDATION. The creation of the district and all 1-24 resolutions, orders, and other acts or attempted acts of the board, 2-1 including the board composed of temporary directors, are validated 2-2 in all respects. The creation of the district and all resolutions, 2-3 orders, and other acts or attempted acts of the board, including 2-4 the board composed of temporary directors, are valid as though they 2-5 originally had been legally authorized or accomplished. 2-6 SECTION 5. EMERGENCY. The importance of this legislation 2-7 and the crowded condition of the calendars in both houses create an 2-8 emergency and an imperative public necessity that the 2-9 constitutional rule requiring bills to be read on three several 2-10 days in each house be suspended, and this rule is hereby suspended, 2-11 and that this Act take effect and be in force from and after its 2-12 passage, and it is so enacted.
