No. 1708 A BILL TO BE ENTITLED AN ACT 1-1 relating to the responsibilities of the district attorney for the 1-2 38th Judicial District. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Section 43.123, Government Code, is amended to 1-5 read as follows: 1-6 Sec. 43.123. 38TH JUDICIAL DISTRICT. (a) The voters of the 1-7 38th Judicial District elect a district attorney. 1-8 (b) The district attorney also represents the state in all 1-9 criminal cases and in all juvenile matters under Title 3, Family 1-10 Code, in the county court at law, county court, and the justice of 1-11 the peace courts in Medina County. 1-12 (c) The Commissioners Court of Medina County may provide 1-13 funding to the district attorney for the prosecution of misdemeanor 1-14 and juvenile cases and may determine the amount and the manner of 1-15 payment of the funding provided to the district attorney under this 1-16 section. 1-17 SECTION 2. This Act takes effect September 1, 1995. 1-18 SECTION 3. The importance of this legislation and the 1-19 crowded condition of the calendars in both houses create an 1-20 emergency and an imperative public necessity that the 1-21 constitutional rule requiring bills to be read on three several 1-22 days in each house be suspended, and this rule is hereby suspended.
