No. 1708 1-2 (In the Senate - Filed May 4, 1995; May 5, 1995, read first 1-3 time and referred to Committee on Criminal Justice; May 11, 1995, 1-4 reported favorably by the following vote: Yeas 6, Nays 0; 1-5 May 11, 1995, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to the responsibilities of the district attorney for the 1-9 38th Judicial District. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Section 43.123, Government Code, is amended to 1-12 read as follows: 1-13 Sec. 43.123. 38TH JUDICIAL DISTRICT. (a) The voters of the 1-14 38th Judicial District elect a district attorney. 1-15 (b) The district attorney also represents the state in all 1-16 criminal cases and in all juvenile matters under Title 3, Family 1-17 Code, in the county court at law, county court, and the justice of 1-18 the peace courts in Medina County. 1-19 (c) The Commissioners Court of Medina County may provide 1-20 funding to the district attorney for the prosecution of misdemeanor 1-21 and juvenile cases and may determine the amount and the manner of 1-22 payment of the funding provided to the district attorney under this 1-23 section. 1-24 SECTION 2. This Act takes effect September 1, 1995. 1-25 SECTION 3. The importance of this legislation and the 1-26 crowded condition of the calendars in both houses create an 1-27 emergency and an imperative public necessity that the 1-28 constitutional rule requiring bills to be read on three several 1-29 days in each house be suspended, and this rule is hereby suspended. 1-30 * * * * *
