No. 52 1-2 (In the Senate - Filed February 15, 1995; February 16, 1995, 1-3 read first time and referred to Committee on Administration; 1-4 April 20, 1995, reported favorably by the following vote: Yeas 6, 1-5 Nays 0; April 20, 1995, sent to printer.) 1-6 SENATE CONCURRENT RESOLUTION 1-7 WHEREAS, CW Systems, Inc., alleges that: 1-8 (1) on or about April 24, 1991, CW Systems, Inc., a software 1-9 development business, entered into a formal contract with the 1-10 University of Houston System to convert and install The University 1-11 of Texas System payroll program onto the University of Houston 1-12 System DEC VAX computers; 1-13 (2) the conversion was to be completed on or about August 1-14 31, 1991, but by agreement the University of Houston System 1-15 extended the deadline to December 31, 1991, so that requested 1-16 changes could be made; 1-17 (3) before the completion of the payroll project, The 1-18 University of Texas System substantially upgraded and improved its 1-19 payroll system; 1-20 (4) the University of Houston System, through its 1-21 consultant, instructed CW Systems, Inc., to cease converting the 1-22 old payroll program and install the new payroll program; 1-23 (5) CW Systems, Inc., made the requested changes and 1-24 converted the new payroll program onto the University of Houston 1-25 System computers; 1-26 (6) the University of Houston System has wrongfully withheld 1-27 payment, and CW Systems, Inc., is entitled to damages because of 1-28 the delays and additional costs incurred in performing the 1-29 additional work; and 1-30 (7) CW Systems, Inc., filed suit against the University of 1-31 Houston System, cause number 92-15658, to recover compensation in 1-32 the amount of $1,063,650, owed to them for the additional work done 1-33 on the installation and conversion of the new payroll system; now, 1-34 therefore, be it 1-35 RESOLVED by the Legislature of the State of Texas, That CW 1-36 Systems, Inc., be and is hereby granted permission to sue the State 1-37 of Texas and the University of Houston System subject to Chapter 1-38 107, Civil Practice and Remedies Code; and, be it further 1-39 RESOLVED, That the chancellor of the University of Houston 1-40 System be served process as provided by Subdivision (3), Subsection 1-41 (a), Section 107.002, Civil Practice and Remedies Code. 1-42 * * * * *
