No. 62 1-2 (In the Senate - Filed February 17, 1995; February 20, 1995, 1-3 read first time and referred to Committee on Administration; 1-4 April 19, 1995, reported favorably by the following vote: Yeas 7, 1-5 Nays 0; April 19, 1995, sent to printer.) 1-6 SENATE CONCURRENT RESOLUTION 1-7 WHEREAS, Cleola Sweed alleges that: 1-8 (1) on or about August 24, 1993, she submitted four bids to 1-9 the Texas Department of Human Services in El Paso, Texas, to 1-10 provide the department with janitorial services; 1-11 (2) on or about August 27, 1993, the Texas Department of 1-12 Human Services unjustly rejected her bids although she was the 1-13 lowest bidder on three of her four bids; 1-14 (3) the Texas Department of Human Services acknowledged that 1-15 not accepting her bids was its mistake and through negotiations 1-16 extended several offers to Cleola Sweed, which she accepted but 1-17 which the department improperly refused to finalize; 1-18 (4) on or about May 2, 1994, the Texas Department of Human 1-19 Services breached its agreement with Cleola Sweed and refused to 1-20 permit her to begin providing janitorial services; and 1-21 (5) due to the breach of contract and the improper conduct 1-22 of the Texas Department of Human Services, Cleola Sweed is entitled 1-23 to receive compensation for her damages, including damages for loss 1-24 of profits, mental anguish, and the foreclosure of her home; now, 1-25 therefore, be it 1-26 RESOLVED by the Legislature of the State of Texas, That 1-27 Cleola Sweed be and is hereby granted permission to sue the State 1-28 of Texas and the Texas Department of Human Services subject to 1-29 Chapter 107, Civil Practice and Remedies Code; and, be it further 1-30 RESOLVED, That the commissioner of the Texas Department of 1-31 Human Services be served process as provided by Subdivision (3), 1-32 Subsection (a), Section 107.002, Civil Practice and Remedies Code. 1-33 * * * * *
