    1-6                     SENATE CONCURRENT RESOLUTION
    1-7        WHEREAS, Imagents, Inc., alleges that:
    1-8        (1)  on or about September 9, 1987, Imagents and The
    1-9  University of Texas Health Science Center entered into a written
   1-10  contract for the use of the health science center's cyclotron unit
   1-11  by Imagents for the purpose of producing radiochemicals;
   1-12        (2)  Imagents fulfilled all its obligations under such
   1-13  contract;
   1-14        (3)  the health science center defaulted in the performance
   1-15  of its obligations under its contract with Imagents; and
   1-16        (4)  Imagents is entitled to compensation for the financial
   1-17  damage suffered as a result of the health science center's default
   1-18  of the contract; now, therefore, be it
   1-19        RESOLVED by the Legislature of the State of Texas, That
   1-20  Imagents, Inc., be and is hereby granted permission to sue the
   1-21  State of Texas and The University of Texas System subject to
   1-22  Chapter 107, Civil Practice and Remedies Code; and, be it further
   1-23        RESOLVED, That the chancellor of The University of Texas
   1-24  System be served process as provided by Subdivision (3), Subsection
   1-25  (a), Section 107.002, Civil Practice and Remedies Code.
