                             SENATE CONCURRENT RESOLUTION
    1-1        WHEREAS, National Projects, Inc., alleges that:
    1-2        (1)  in the month of November, 1990, it entered into
    1-3  contracts with the Texas Department of Criminal Justice;
    1-4        (2)  under the contracts it was to construct prisons at
    1-5  Dilley and Beeville, Texas;
    1-6        (3)  it worked in good faith to comply with all the terms of
    1-7  the contract under the timeline prescribed by the Texas Department
    1-8  of Criminal Justice and according to the designs supplied by the
    1-9  Texas Department of Criminal Justice;
   1-10        (4)  the Texas Department of Criminal Justice has failed to
   1-11  comply with the provisions of the contract and failed to pay
   1-12  National Projects, Inc., money rightfully owed in spite of the fact
   1-13  that National Projects, Inc., had complied with all the conditions
   1-14  of the contract;
   1-15        (5)  National Projects, Inc., is entitled to damages due to
   1-16  the breach of contract by the Texas Department of Criminal Justice;
   1-17  now, therefore, be it
   1-18        RESOLVED by the Legislature of the State of Texas, That
   1-19  National Projects, Inc., be and is hereby granted permission to sue
   1-20  the State of Texas and the Department of Criminal Justice subject
   1-21  to Chapter 107, Civil Practice and Remedies Code; and, be it
   1-22  further
   1-23        RESOLVED, That the Executive Director of the Texas Department
    2-1  of Criminal Justice be served process as provided by Subdivision
    2-2  (3), Subsection (a), Section 107.002, Civil Practice and Remedies
    2-3  Code.
