    1-6                     SENATE CONCURRENT RESOLUTION
    1-7        WHEREAS, Public institutions of higher education have
    1-8  experienced a growing incidence of divisive personnel disputes,
    1-9  often culminating in expensive, protracted grievance procedures and
   1-10  litigation; and
   1-11        WHEREAS, The use of mediation and other alternative dispute
   1-12  resolution techniques has the potential to reduce the number of
   1-13  such disputes resulting in formal grievance procedures and
   1-14  litigation and to resolve such disputes more quickly and peaceably
   1-15  than traditional grievance and litigation procedures; and
   1-16        WHEREAS, The Alternative Dispute Resolution Procedures Act of
   1-17  1987 declared and the 74th Legislature reaffirms that it is the
   1-18  policy of the State of Texas to encourage the peaceable resolution
   1-19  of disputes through alternative dispute resolution; and
   1-20        WHEREAS, It is unclear to what extent public institutions of
   1-21  higher education have examined or implemented alternative dispute
   1-22  resolution methods for the resolution of personnel and other
   1-23  disputes within those institutions; now, therefore, be it
   1-24        RESOLVED, That the 74th Legislature of the State of Texas
   1-25  hereby request the Texas Higher Education Coordinating Board to
   1-26  conduct a review of the current use of alternative dispute
   1-27  resolution by public institutions of higher education in this
   1-28  state; and, be it further
   1-29        RESOLVED, That not later than July 1, 1996, the Texas Higher
   1-30  Education Coordinating Board may provide a report of its review to
   1-31  the 74th Legislature, with copies of the report delivered to the
   1-32  presiding officer of each house, the chair of the Senate Committee
   1-33  on Education, and the chair of the House Committee on Higher
   1-34  Education; and, be it further
   1-35        RESOLVED, That the 74th Legislature of the State of Texas
   1-36  hereby encourage public institutions of higher education to
   1-37  cooperate with the Texas Higher Education Coordinating Board in
   1-38  conducting the review provided by this resolution.
