By: Whitmire S.J.R. No. 43 SENATE JOINT RESOLUTION 1-1 proposing a constitutional amendment relating to garnishment of 1-2 wages for court-ordered restitution in a criminal judgment and 1-3 court-ordered reimbursement to the state for compensation to 1-4 victims of crimes. 1-5 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-6 SECTION 1. Section 28, Article XVI, Texas Constitution, is 1-7 amended to read as follows: 1-8 Sec. 28. No current wages for personal service shall ever be 1-9 subject to garnishment, except for the enforcement of court-ordered 1-10 child support payments, court-ordered restitution in a criminal 1-11 judgment, or court-ordered reimbursement to the state for 1-12 compensation to victims of crimes. 1-13 SECTION 2. This proposed constitutional amendment shall be 1-14 submitted to the voters at an election to be held on November 7, 1-15 1995. The ballot shall be printed to permit voting for or against 1-16 the proposition: "The constitutional amendment permitting 1-17 garnishment of wages for court-ordered restitution in a criminal 1-18 judgment or for court-ordered reimbursement for compensation to 1-19 victims of crimes."
