1-7 COMMITTEE SUBSTITUTE FOR S.J.R. No. 43 By: Whitmire
1-8 SENATE JOINT RESOLUTION
1-9 proposing a constitutional amendment relating to garnishment of
1-10 wages for court-ordered restitution in a criminal judgment and
1-11 court-ordered reimbursement to the state for compensation to
1-12 victims of crimes.
1-13 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-14 SECTION 1. Section 28, Article XVI, Texas Constitution, is
1-15 amended to read as follows:
1-16 Sec. 28. No current wages for personal service shall ever be
1-17 subject to garnishment, except for the enforcement of court-ordered
1-18 child support payments, court-ordered restitution in a criminal
1-19 judgment, or court-ordered reimbursement to the state for
1-20 compensation to victims of crimes.
1-21 SECTION 2. This proposed constitutional amendment shall be
1-22 submitted to the voters at an election to be held on November 7,
1-23 1995. The ballot shall be printed to permit voting for or against
1-24 the proposition: "The constitutional amendment permitting
1-25 garnishment of wages for court-ordered restitution in a criminal
1-26 judgment or for court-ordered reimbursement for compensation to
1-27 victims of crimes."
