R E S O L U T I O N
1-1 BE IT RESOLVED by the Senate of the State of Texas, 74th
1-2 Legislature, Regular Session, 1995, That Senate Rule 12.03 be
1-3 suspended in part as provided by Senate Rule 12.08 to enable the
1-4 conference committee appointed to resolve the differences on Senate
1-5 Bill No. 1128 to consider and take action on the following specific
1-6 matters:
1-7 1. Senate Rule 12.03(4) is suspended to permit the committee
1-8 to add a new Section 31 to the bill to read as follows:
1-9 SECTION 31. Sections 16.260(b), (c), and (d), Education
1-10 Code, are amended to read as follows:
1-11 (b) Payments from the foundation school fund to each
1-12 category 1 school district shall be made as follows:
1-13 (1) 15 <21> percent of the yearly entitlement of the
1-14 district shall be paid in an installment <two equal installments>
1-15 to be made on or before the 25th day of September <and October> of
1-16 a fiscal year;
1-17 (2) 80 <57> percent of the yearly entitlement of the
1-18 district shall be paid in eight <six> equal installments to be made
1-19 on or before the 25th day of October, November, December, January,
1-20 <February,> March, May, June, and July; and
1-21 (3) five <22> percent of the yearly entitlement of the
1-22 district shall be paid in an installment <two equal installments>
1-23 to be made on or before the 25th day of February <April and May>.
1-24 (c) Payments from the foundation school fund to each
2-1 category 2 school district shall be made as follows:
2-2 (1) 22 <21> percent of the yearly entitlement of the
2-3 district shall be paid in an installment <two equal installments>
2-4 to be made on or before the 25th day of September <and October> of
2-5 a fiscal year;
2-6 (2) 18 <38> percent of the yearly entitlement of the
2-7 district shall be paid in an installment <four equal installments>
2-8 to be made on or before the 25th day of October <November,
2-9 December, March, and July>;
2-10 (3) 9.5 <seven> percent of the yearly entitlement of
2-11 the district shall be paid in an installment <two equal
2-12 installments> to be made on or before the 25th day of November
2-13 <January and February>;
2-14 (4) 7.5 <22> percent of the yearly entitlement of the
2-15 district shall be paid in an installment <two equal installments>
2-16 to be made on or before the 25th day of April <and May>; <and>
2-17 (5) five <12> percent of the yearly entitlement of the
2-18 district shall be paid in an installment <two equal installments>
2-19 to be made on or before the 25th day of May <June and August>;
2-20 (6) 10 percent of the yearly entitlement of the
2-21 district shall be paid in an installment to be made on or before
2-22 the 25th day of June;
2-23 (7) 13 percent of the yearly entitlement of the
2-24 district shall be paid in an installment to be made on or before
2-25 the 25th day of July; and
2-26 (8) 15 percent of the yearly entitlement of the
2-27 district shall be paid in an installment to be made on or before
3-1 the 25th day of August.
3-2 (d) Payments from the foundation school fund to each
3-3 category 3 school district shall be made as follows:
3-4 (1) 45 <21> percent of the yearly entitlement of the
3-5 district shall be paid in an installment <two equal installments>
3-6 to be made on or before the 25th day of September <and October> of
3-7 a fiscal year;
3-8 (2) 35 <57> percent of the yearly entitlement of the
3-9 district shall be paid in an installment <six equal installments>
3-10 to be made on or before the 25th day of October <November,
3-11 December, March, June, July, and August>; and
3-12 (3) 20 <22> percent of the yearly entitlement of the
3-13 district shall be paid in an installment <two equal installments>
3-14 to be made on or before the 25th day of August <April and May>.
3-15 Explanation: This addition is necessary to enable the state
3-16 to accelerate payments from the foundation school fund.
3-17 2. Senate Rule 12.03(4) is suspended to permit the committee
3-18 to add Subsection (c) to Section 32 of the bill, renumbered as
3-19 Section 33, to read as follows:
3-20 (c) The change in law made by this Act in Section 16.260,
3-21 Education Code, prevails over any conflicting Act of the 74th
3-22 Legislature, Regular Session, 1995, including Senate Bill No. 1,
3-23 regardless of the relative dates of enactment.
3-24 Explanation: This addition is necessary for the preceding
3-25 addition, relating to distribution of the foundation school fund,
3-26 to become effective.
