LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE 74th Regular Session March 21, 1995 TO: Honorable Keith Oakley, Chair IN RE: House Bill No. 243 Committee on Public Safety By: Yarbrough House of Representatives Austin, Texas FROM: John Keel, Director In response to your request for a Fiscal Note on House Bill No. 243 (relating to the carrying of certain weapons by judges and justices) this office has determined the following: The bill would make no appropriation but could provide the legal basis for an appropriation of funds to implement the provisions of the bill. The bill would require the Texas Commission on Law Enforcement Officer Standards and Education to develop and administer a weapons safety and proficiency program for judges and justices listed under Section 46.02(g), Penal Code. The bill would provide a legal defense against prosecution under Section 46.02 Penal Code for judges and justices who have firearms proficiency certificates issued by the Commission. The bill would authorize the Texas Commission on Law Enforcement Officer Standards and Education to establish reasonable and necessary fees to administer the provisions contained in the bill. It is assumed that the fees will be established on a cost recovery basis.
