FROM: John Keel, Director

In response to your request for a Fiscal Note on House Bill No.
368 (relating to creating the offense of transferring a handgun
to a person who is the subject of a protective order and
including in the computerized criminal history system maintained
by the Department of Public Safety information relating to
protective orders) this office has determined the following:

The bill would make no appropriation but could provide the legal
basis for an appropriation of funds to implement the provisions
of the bill.

The bill creates an offense of transferring a handgun to a person
who is subject of a protective order. Additionally, the bill
requires the Department of Public Safety to maintain records of
those protective orders in the criminal history system.

The probable fiscal implication of implementing the provisions of
the bill during each of the first five years following passage
is estimated as follows:

Fiscal Probable Cost Out Change in
Year of General Number of State
                       Revenue Employees from
                       Fund 001 FY 1995

        1996 $100,933 2.0

        1997 72,477 2.0
        1998 72,477 2.0

        1999 72,477 2.0

        2000 72,477 2.0

Similar annual fiscal implications would continue as long as the
provisions of the bill are in effect.

The fiscal implication to units of local government cannot be
determined.
