In response to your request for a Fiscal Note on House Bill No.
383 (Relating to liability of certain governmental units and to
the employees and officers of those units.) this office has
determined the following:

The bill would require a individual with a potential tort claim
against a governmental entity to elect whether to bring the cause
of action under the Texas Tort Claims Act or directly against the
governmental officer or employee.  It is anticipated that this
would reduce legal defense costs for the state and units of local
government.  The amount of the potential savings to the state and
units of local government cannot be determined.
