LEGISLATIVE BUDGET BOARD
Austin, Texas
FISCAL NOTE
74th Regular Session
March 22, 1995
TO: Honorable Keith Oakley, Chair IN RE: Committee Substitute
Committee on Public Safety for House Bill No. 523
House of Representatives
Austin, Texas
FROM: John Keel, Director
In response to your request for a Fiscal Note on House Bill No.
523 (relating to stolen vehicle checkpoints near the Mexico
border; relating to the jurisdiction of a magistrate to hear a
stolen property disposition hearing; relating to certain
information required on a certificate of title) this office has
determined the following:
The bill would make no appropriation but could provide the legal
basis for an appropriation of funds to implement the provisions
of the bill.
The bill would amend Subsection (b) of Section 411.0095,
Government Code, to allow a checkpoint to be established if
within 250 yards north of a federally designated crossing at the
Mexican border.
The bill would amend Section (a) of Article 47.01a, Code of
Criminal Procedure, to allow an official having jurisdiction as a
magistrate to hold a hearing to determine the right of possession
of allegedly stolen property.
No significant fiscal implication to the State is anticipated.
The fiscal implication to units of local government cannot be
determined.
