Hunter, Chair IN RE: House BillNo. 1391, Committee on Civil Practices as amended House of Representatives By: Place Austin, Texas FROM: John Keel, Director In response to your request for a Fiscal Note on House Bill No. 1391 (Relating to free trial transcripts for appeals in which an affidavit of inability to pay costs has been filed.) this office has determined the following: The bill would require a court clerk to provide a free transcript of the statement of facts on appeal if an affadavit of inability to pay the cost of the appeal was filed, the trial judge finds the appeal is not frivolous, and the statement of facts is needed to decide the issue presented on appeal.
