LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE 74th Regular Session March 29, 1995 TO: Honorable Toby Goodman, Chair IN RE: House Bill No. 1632 Committee on Juvenile Justice and By: Thompson Family Issues House of Representatives Austin, Texas FROM: John Keel, Director In response to your request for a Fiscal Note on House Bill No. 1632 (relating to protective orders for family violence; providing penalties) this office has determined the following: The bill would make no appropriation but could provide the legal basis for an appropriation of funds to implement the provisions of the bill. This bill would revise various statutes relating to protective orders for family violence. Section 11 of the bill would allow a court to require the Department of Protective and Regulatory Services to provide services or take other action in relation to a party or member of a family or household covered by a protective order. The department estimates that this provision could bring up to 16,000 additional children into its purchased service system. Section 16 of the bill would lower the maximum fine for violating the provisions of a protective order from $10,000 to $4,000. The fiscal impact on district and county courts would depend on the number and amounts of the fines levied and cannot be determined. The probable fiscal implication of implementing the provisions of the bill during each of the first five years following passage is estimated as follows: Fiscal Probable Cost Out Probable Cost Out Year of General of Revenue Federal Funds 555 Fund 001 1996 $1,535,181 $3,064,819 1997 1,535,181 3,064,819 1998 1,535,181 3,064,819 1999 1,535,181 3,064,819 2000 1,535,181 3,064,819 Similar annual fiscal implications would continue as long as the provisions of the bill are in effect.
