LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE 74th Regular Session April 24, 1995 TO: Honorable Keith Oakley, Chair IN RE: Committee Substitute Committee on Public Safety for House of Representatives HouseBill No. Austin, Texas 1726 FROM: John Keel, Director In response to your request for a Fiscal Note on House Bill No. 1726 (relating to the criminal background information obtained by the Texas Commission on Alcohol and Drug Abuse) this office has determined the following: The bill would make no appropriation but could provide the legal basis for an appropriation of funds to implement the provisions of the bill. The bill would permit the Texas Commission on Alcohol and Drug Abuse to access the criminal history of applicants for a chemical dependency counselor's license, current licensees, and executive officers and board members of a business entity licensed to receive funds from the commission. The Commission may charge fees, set as reasonably necessary, to access such criminal history records. These fees are appropriated to the Commission and are not credited to the Licensed Chemical Dependency Counselor's Fund/Account (since a fund is not mentioned, the General Revenue Fund is presumed to be the recipient of the fee revenues). Since the amount of the fees and the number of criminal records to be reviewed cannot be estimated at this time, the fiscal impact to the General Revenue Fund cannot be determined.
