LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE 74th Regular Session March 19, 1995 TO: Honorable Fred Hill, Chair IN RE: House Bill No. 1743 Committee on Urban Affairs By: Glaze House of Representatives Austin, Texas FROM: John Keel, Director In response to your request for a Fiscal Note on House Bill No. 1743 (relating to preservation of historic properties by certain municipalities) this office has determined the following: The bill would amend Chapter 214 of the Local Government Code to allow municipalities designated as Certified Local Governments to determine whether certain substandard properties under consideration for receivership qualify for the National Register of Historic Places, as a Recorded Texas Historic Landmark, or as a historic property through local historic designation. If it is determined through review that a building could be rehabilitated and designated as a historic property, the building could not be demolished for a specified period of time, during which an attempt must be made to identify a feasible alternative use or to locate a purchaser to rehabilitate the property. The bill would also allow a district court, after a public hearing, to facilitate the transfer of property to a nonprofit organization or to a historic property rehabilitator. No fiscal implication to the State is anticipated. The fiscal implications to local governments cannot be determined as it is not known how many of the 40 Certified Local Governments affected by the bill would chose to exercise this authority.
