LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE 74th Regular Session April 11, 1995 TO: Honorable Edmund Kuempel, Chair IN RE: House Bill No. 1823 Committee on State Recreational By: Bosse Resources House of Representatives Austin, Texas FROM: John Keel, Director In response to your request for a Fiscal Note on House Bill No. 1823 (Relating to regulation by the Parks and Wildlife Department of the taking of marl, sand, gravel, shell, or mudshell; providing a civil penalty.) this office has determined the following: The bill would make no appropriation but could provide the legal basis for an appropriation of funds to implement the provisions of the bill. The bill would amend Chapter 86 of the Parks and Wildlife Code in order to provide greater flexibility to the Parks and Wildlife Department in determining the activities which require a permit, and the activities which do not require a permit because they are conducted in accordance with certain conditions. The bill would authorize the Parks and Wildlife Commission to require a nonrefundable processing fee to be submitted with the certain non-permitted activities for which notification is required. The bill would also clarify language regarding Parks and Wildlife's authority to adopt rules regarding permits, including the setting and collection of application fees, the exemption of certain long-term continuing projects from repetitious permitting processes. According to Parks and Wildlife, the bill would streamline the process by which permits are issued, and result in greater efficiency. The bill could result in a revenue gain to Game, Fish, and Water Safety Receipts (Account 009). The amount of the revenue gain cannot be determined, but is not expected to be significant.
