Hunter, Chair IN RE: House Bill No. 2042 Committee on Civil Practices By: Hochberg House of Representatives Austin, Texas FROM: John Keel, Director In response to your request for a Fiscal Note on House Bill No. 2042 (relating to civil remedies for certain nuisances) this office has determined the following: The bill would provide for the appointment of a receiver as an additional remedy in nuisance cases. The court on its own motion or on the motion of any party may order the appointment of a receiver to manage the property for up to one year. The court determines the amount paid, the method of payment and the payment periods. If the court orders one of the parties to pay the receiver, there will be no costs to the local units of government. If, however, the court pays the receiver, then the costs are incurred by the local units of government. No fiscal implication to the State is anticipated.
