LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE 74th Regular Session April 3, 1995 TO: Honorable Warren Chisum, Chair IN RE: House Bill No. 2349 Committee on Environmental Regulation By: Kuempel House of Representatives Austin, Texas FROM: John Keel, Director In response to your request for a Fiscal Note on House Bill No. 2349 (Relating to the regulation of sanitary landfills.) this office has determined the following: The bill would prohibit the Texas Natural Resource Conservation Commission (TNRCC) from imposing any standard or requirement on a sanitary landfill that is more stringent than a standard or requirement of the federal government. The TNRCC would be required to allow the maximum flexibility permissable under federal regulations in the design of landfills. The bill would allow landfill operators to petition the TNRCC for a review of landfill requirements and a certification that they do not exceed federal requirements. The TNRCC would be required to biennially report on the requests for review received and a summary of opinions provided. The bill would eliminate some permitting requirements. While it is anticipated that the elimination of some permitting requirements will result in a cost savings to the state, these savings will be partially offset by additional costs incurred by the TNRCC as a result of petition review and reporting requirements.
